After divorce, one parent may wish—or be required—to relocate, whether to another province or abroad. Such relocations often arise due to new employment opportunities, remarriage, or personal circumstances. However, when minor children are involved, a parent cannot simply move them without the other parent’s consent.
If consent is withheld, the relocating parent must apply to court for permission. The court will carefully assess what is in the best interests of the child, taking into account stability, schooling, family ties, and the child’s relationship with both parents.
